Non-Qualified Assignment Flex Agreement

The newly released NQA Flex Agreement (NQA-FA) gives attorneys, claimants and defendants in non-physical injury cases far more control over the timing and design of settlement payments.

The basics

What is the NQA-FA?

The NQA-FA is a settlement solution, based on a funding agreement, designed for non-physical injury cases. Unlike a traditional structured settlement annuity, it allows deferred start dates, lump sums, annual increases and fully custom payment schedules.

It is issued by a highly reputable U.S. life insurance company rated A+ by A.M. Best.

Eligible cases

Who it's designed for

  • Employment litigation
  • Wrongful termination
  • Discrimination claims
  • Contract disputes
  • Construction defects
  • Property and environmental claims
  • Liability policy buy-outs
  • Punitive damages
  • Attorney fees

With approval, both individuals and businesses can be named as payees.

What's different

Payments can start after the first year

Traditional non-qualified assignments generally fall under Internal Revenue Code Section 72(u), which requires payments to begin within one year of settlement.

The NQA-FA is not subject to that requirement, so payments can be deferred past one year and timed around future events or long-term needs.

Key features

Why attorneys use it

  • Payment flexibility

Deferred starts, lump sums, annual increases and custom schedules.

  • Broad eligibility

Built for non-physical injury claims, the majority of employment and civil cases.

  • Tax management

Spreading payments over time avoids one large tax bill in a single year.

  • Guaranteed payments

The obligation moves to an assignment company, freeing the defendant and backing the payments with a leading financial institution.
